Many people appreciate the benefits of the different purposes of assistance dogs in their lives. Service Dog Registry USA is formed and operated for the people with disabilities may it be in physical, mental or emotional. Service dog, Emotional Support Dog and Therapy Dog differ with their purposes, exemptions, rules in public, and their task to their owner or handler. But they have a common goal and that is to save more lives.

 

Do you want to have an Emotional Support Animal? Your dog must qualify first as an Emotional Support Animal and you as an owner should have a prescription by a Licensed Mental Health Professional (LMHP) stating that you’re in need of an Emotional Support Animal for you fast recovery from your disorder. According to U.S Department of Housing and Urban Development (HUD) that the assistance animal is not a pet while the Air Carriers Access Act (ACAA) and the Fair Housing Act (FHAct) ask for an adjustment of “no pets” policies for emotional support animals.

 

The Fair Housing Act (FHAct) is a federal act in the United States intended to protect the buyer or renter of a dwelling from seller or landlord discrimination. According to FHAct (42 U.S.C.A. 3601 et seq.), an Emotional Support Animal is a type of assistance animal that is recognized as a “reasonable accommodation” for a person with a disability. Moreover, FHAct of 1988 and Section 504 of the Rehabilitation Act of 1973 (§ 504) protect the right of people with disabilities to keep Emotional Support Animals, even when a landlord's policy explicitly prohibits pets. Since the emotional support and service animal are not considered as “pets” but an assistive aid.

Guidelines to be followed by the owner of Emotional Support Dog

Wherever you go in this world there is an existing rule to be followed. State laws and local animal ordinances are some of that rule implemented. Service animal and ESA owners should abide it, as well as the guidelines of Housing policies, but not limited to, the following:

(1).It is improper that the owners who will execute the act of animal cruelty on private or state property.

  1. In public, all animal must be well-behaved. (no barking, whining, squawking, scratching, chewing, or aggression) ID or rabies tag is necessary for dogs.

  2. Any training for a service animal shall not be denied admittance or accommodations when accompanied by an approved trainer

  3. Resident (both indoors and outdoors) are responsible for any animal waste. It should be cleared up in a timely and effective fashion.

  4. Veterinarians’ recommended vaccinations should be prepared for the verification. The same as the proof of the absence of any communicable diseases, fleas and parasites. You should secure a copy of vaccination record.

  5.  The resident in case of an emergency care will be providing the housing and any contact information that will serve as an alternative caregiver.

Laws protecting the Emotional Support Animal

Each type of assistance animals and their handlers are distinct, and there is a law that will govern. Under Americans with Disabilities Act (ADA), an Emotional Support Animal doesn’t have the same rights compared to Service Dog. Laws protecting the Emotional Support Animal

  • The owner must secure a letter from your licensed mental health professional (or other medical professionals) stating that you are in need of an ESA.

  • Must also include the doctor’s license number, where it was issued and the date it was issued.

  • ESA letter must be on your mental health professional’s letterhead.

  • The ESA letter must be updated annually.
