WISCONSIN SERVICE DOG LAWS

UNDER CRUELTY LAW DEFINITIONS:

“Service dog” means a dog that is trained for the purpose of assisting a person with a sensory, mental, or physical disability or accommodating such a disability.

PUBLIC ACCOMMODATION LAW

No person may deny to another or either charges a higher price than the regular rate for the full and equal enjoyment of any public place of accommodation or amusement due its disability and being assisted by a service animal. S. A. 106.52

 

HOUSING ACCOMMODATION LAW

An individual who is experiencing visual and hearing impairment then being refused by an authorized person to rent or sell housing is considered discrimination. Any cause of eviction, require extra compensation, or engage in harassment because he or she keeps an animal that is specially trained to lead the individual with impaired vision, hearing or mobility if all of the conditions listed in the law is applied. S. A. 106.50

 

HARASSMENT OF INTERFERENCE WITH SERVICE DOGS

Any person may provide notice to another person in any manner that the latter person's behavior is interfering with the use of a service dog and may request that the latter person stop engaging in that behavior.

 

Interference with service dog:

  • No person may recklessly interfere with the use of the service dog by obstructing or intimidating it or otherwise jeopardizing its safety or the safety of its user

  • No person may intentionally interfere with the use of the service dog by obstructing or intimidating it or otherwise jeopardizing its safety or the safety of its user.

Allowing service dog to interfere:

  • No person may recklessly allow his or her dog to interfere with the use of a service dog by obstructing or intimidating it or otherwise jeopardizing its safety or the safety of its user (class B misdemeanor)

  • No person may intentionally allow his or her dog to interfere with the use of a service dog by obstructing or intimidating it or otherwise jeopardizing its safety or the safety of its user (class A misdemeanor).

Injure a service dog:

  • No person may recklessly injure a service dog or allow his or her dog to injure a service dog (class A misdemeanor).

  • No person may intentionally injure a service dog or intentionally allow his or her dog to injure a service dog (Class I felony).

Kill a service dog:

  • No person may recklessly cause the death of a service dog (Class I felony).

  • No person may intentionally cause the death of a service dog  (Class H felony).

DRIVING LAW

The vehicle operator shall stop the vehicle before approaching closer than 10 feet to a pedestrian who is accompanied by a service animal, and shall take such precautions as may be necessary to avoid accident or injury to the pedestrian.  S. A. 346.26
